MUKIYA Terms of Service covering orders, products, shipping, returns, warranty, privacy, and customer rights.
OVERVIEW
This website is operated by MUKIYA. Throughout the site, the terms "MUKIYA," "we," "us," and "our" refer to the business that operates MUKIYA and this website. MUKIYA offers this website, including the information, content, features, tools, products, and services available through it (collectively, the "Service"), to you subject to these Terms of Service (the "Terms").
By visiting our website, creating an account, placing an order, or otherwise using any part of the Service, you agree to these Terms and to the policies incorporated into them by reference, including our Privacy Policy, Refund Policy, Shipping Policy, and Warranty Policy. If you do not agree, do not use the Service.
These Terms apply to all users of the Service, including browsers, customers, merchants, vendors, and content contributors. Any new features or tools added to the Service will also be subject to these Terms.
Our online store is hosted by Shopify Inc. Shopify provides the e-commerce platform that enables us to offer and sell our products and services.
Nothing in these Terms limits any consumer right or remedy that cannot lawfully be limited or excluded under applicable law.
SECTION 1 - ELIGIBILITY AND ONLINE STORE TERMS
By using the Service, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are the age of majority and have authorized any minor dependent under your supervision to use the Service.
You may use the Service and our products only for lawful purposes. You must not use the Service or any product in a way that violates applicable law, infringes another person's rights, or introduces viruses, malware, destructive code, or other harmful material.
We may suspend or terminate access to the Service if we reasonably believe that these Terms have been violated or that use of the Service creates a risk of harm, fraud, abuse, or legal liability.

We reserve the right to refuse or restrict the Service or an order where reasonably necessary, including to prevent fraud, abuse, resale activity, sanctions violations, unlawful conduct, or harm to MUKIYA, our customers, or third parties. We will not exercise this right in a way prohibited by applicable law.
Information transmitted through the Service may pass through different networks and may be adapted to technical requirements. Payment information is handled by Shopify and/or authorized payment providers and is encrypted in transit using the security methods supported by those providers.
You may not reproduce, duplicate, copy, sell, resell, reverse engineer, or exploit any portion of the Service without our prior written permission, except where applicable law expressly allows it.
Section headings are provided for convenience and do not affect the interpretation of these Terms.
SECTION 3 - ACCOUNTS AND CUSTOMER INFORMATION
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Please notify us promptly at support@mukiya.com if you believe your account has been accessed without authorization.
You agree to provide current, complete, and accurate account, billing, shipping, and purchase information. You must promptly update information that changes so that we can process transactions and contact you when necessary.
You are responsible for confirming that the email address, shipping address, product selection, quantity, and device compatibility information in your order are correct before submitting it.
SECTION 4 - PRODUCT INFORMATION AND COMPATIBILITY
We make reasonable efforts to describe and display our products accurately, including their features, specifications, dimensions, compatibility, colors, and images. Actual colors and appearance may vary depending on your screen, lighting, device, production batch, and other factors.
Compatibility can depend on a laptop, tablet, phone, operating system, port specification, cable, monitor, display protocol, power adapter, and other connected equipment. Before ordering, please review the compatibility information and technical specifications on the applicable product page. If you are unsure whether a product will work with your setup, contact support@mukiya.com before purchase.
Product descriptions, specifications, packaging, included accessories, and availability may be updated from time to time. A material change will not apply retroactively to an order already accepted unless required by law, needed for safety, or agreed with you.
Some products or services may be available exclusively online and may have limited quantities. We may discontinue a product at any time, subject to fulfilling accepted orders and applicable legal obligations.
SECTION 5 - PRICES, DISCOUNTS, TAXES, AND CURRENCY
Prices, promotions, and product availability may change without notice before an order is accepted. The price displayed at checkout at the time you submit your order is the price that applies, except in the case of an obvious pricing or typographical error addressed under Section 16.
Unless stated otherwise, discounts cannot be combined. Promotions may be subject to separate eligibility requirements, exclusions, quantities, dates, or other terms displayed with the promotion.
Prices may be shown in a localized currency for convenience. Your bank, card issuer, or payment provider may apply currency conversion rates or additional fees. Taxes, duties, import charges, and similar government assessments will be handled as shown at checkout or as otherwise required by applicable law and our Shipping Policy.
SECTION 6 - ORDERS AND ORDER ACCEPTANCE
Submitting an order is an offer to purchase. An automated order confirmation acknowledges that we received your order but does not necessarily mean that we have accepted it. We accept an order when we confirm shipment or otherwise expressly confirm acceptance.
We may limit or cancel an order before acceptance for legitimate reasons, including product unavailability, suspected fraud, pricing or listing errors, payment authorization failure, shipping restrictions, sanctions compliance, or quantities that reasonably appear intended for unauthorized resale. Restrictions may apply to orders associated with the same customer account, payment method, billing address, or shipping address.
If we cancel an order after payment has been authorized or collected, we will void the authorization or issue a refund to the original payment method, as applicable. We will use the contact information supplied with the order to notify you.
If you need to change or cancel an order, contact support@mukiya.com as soon as possible. We cannot guarantee changes or cancellations after fulfillment has begun.
SECTION 7 - SHIPPING AND DELIVERY
MUKIYA's standard customer promise is fast, free shipping for eligible orders and destinations. Shipping is free only where the product page, checkout, or Shipping Policy identifies the order and destination as eligible for free standard shipping. Current country-specific standard delivery estimates after dispatch are 3 to 10 business days for the United States, 5 to 12 for Canada, 5 to 10 for Australia, 5 to 10 for the United Kingdom, 5 to 10 for Germany, and 6 to 12 for Japan. The Shipping Policy and checkout disclosure control the accepted order.
Delivery dates are estimates rather than guaranteed deadlines. Processing time, inventory location, destination, customs review, carrier conditions, severe weather, holidays, incorrect address information, and events outside our reasonable control may affect delivery. Any different shipping charge, processing time, or delivery estimate applicable to an order will be disclosed on the product page, at checkout, or in the Shipping Policy.
You are responsible for providing a complete and accurate delivery address. If a parcel is returned, delayed, or lost because the address supplied was incomplete or incorrect, additional charges may apply to the extent permitted by law.
Risk of loss and title pass as provided by applicable law. Nothing in these Terms shifts carrier risk to a consumer where the law requires MUKIYA to remain responsible until delivery.

SECTION 8 - 30-DAY RETURNS, REFUNDS, AND EXCHANGES
Eligible products purchased through this website may be returned within 30 days after delivery, subject to the conditions, exclusions, and return procedure in our Refund Policy. If an eligible return is approved, we will refund the purchase price of the returned product using the original payment method, subject to the Refund Policy, any disclosed non-refundable charges, and applicable law.
To request a return, contact support@mukiya.com before sending a product back. Items returned without authorization or to an address not provided by our support team may be delayed or refused where permitted by law.
Products should be returned in the condition required by the Refund Policy, together with the included accessories, components, documentation, and proof of purchase. Different rules may apply to defective, damaged, incorrect, customized, final-sale, gift card, or hygiene-sensitive items, as stated in the Refund Policy and subject to applicable law.
Approved refunds are issued to the original payment method unless otherwise required by law. Banks and payment providers may need additional time to post a refund after we process it.

SECTION 9 - TWO-YEAR LIMITED PRODUCT WARRANTY
MUKIYA-branded products purchased from this website include a two-year limited product warranty beginning on the original purchase date shown on valid proof of purchase, unless a longer warranty period is expressly stated for a particular product. If applicable law requires a different start date, the legally required date applies.
The warranty applies to covered defects in materials or workmanship under normal, intended use. Coverage, claim requirements, available remedies, territorial limitations, and exclusions are explained in the Warranty Policy. Typical exclusions may include normal wear, cosmetic damage that does not affect function, misuse, accidents, unauthorized modification or repair, improper installation, incompatible equipment, external electrical events, and use contrary to product instructions, to the extent permitted by law.
Warranty service may require proof of purchase, the order number, product serial information, photos or video, troubleshooting, and return of the affected product. Depending on the circumstances and applicable law, the remedy may include repair, replacement, replacement parts, or refund.
This limited warranty is in addition to, and does not replace or restrict, any mandatory statutory warranty or consumer guarantee that applies to you.

SECTION 10 - PAYMENT AND CHECKOUT SECURITY
Available payment methods are displayed at checkout and may vary by location. Payments are processed by Shopify and/or other authorized payment providers. Their terms and privacy practices may also apply to the processing of your transaction.
We use the security features made available by our e-commerce and payment providers, including encryption of payment information during transmission. However, no internet transmission or storage system can be guaranteed to be completely secure. You are responsible for using a trusted device and network and for protecting your account and payment credentials.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges, taxes, shipping charges, and other amounts disclosed at checkout.
SECTION 11 - ACCURACY AND TIMELINESS OF INFORMATION
We make reasonable efforts to keep information on the Service accurate and current. General educational, comparison, blog, or historical content may not reflect the latest product specification, price, policy, or availability and should not replace the information shown on the relevant product page or at checkout.
We may update content when appropriate. Your rights regarding an accepted order will be determined by the information and terms applicable when the order was accepted, together with applicable law.
SECTION 12 - OPTIONAL AND THIRD-PARTY TOOLS
The Service may provide access to tools, applications, integrations, or features operated by third parties. We may not control or monitor those third-party services.
Third-party tools are provided subject to the third party's terms and privacy practices. To the extent permitted by law, your use of an optional third-party tool is at your discretion. We are not responsible for a third party's independent acts or omissions, but this does not limit any responsibility that applicable law places on MUKIYA.
New tools or features introduced through the Service will also be subject to these Terms unless separate terms are presented.
SECTION 13 - THIRD-PARTY LINKS, PRODUCTS, AND SERVICES
The Service may contain links to websites or services that are not operated by MUKIYA. A link does not necessarily mean that we endorse or control the third party.
Please review a third party's terms and policies before entering into a transaction with it. Questions or claims regarding a product or service purchased directly from a third party should be directed to that third party. Nothing in this section excludes liability that cannot lawfully be excluded.
SECTION 14 - REVIEWS, FEEDBACK, AND OTHER USER CONTENT
If you submit a review, photo, video, comment, suggestion, idea, or other content (collectively, "User Content"), you retain ownership of your User Content. You grant MUKIYA a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, translate, publish, display, distribute, and use that User Content for operating, improving, and promoting MUKIYA and the Service, in any media, subject to applicable law and our Privacy Policy.
You represent that you own or have permission to submit the User Content and that it is accurate based on your genuine experience. User Content must not infringe intellectual property, privacy, publicity, or other rights; contain unlawful, abusive, misleading, defamatory, obscene, or malicious material; include malware; impersonate another person; or conceal a material incentive where disclosure is legally required.
We may moderate, reject, or remove User Content that violates these Terms, our policies, platform rules, or applicable law. We are not required to publish every submission. We will not edit a customer review in a way that materially changes its meaning.
We may contact you about submitted User Content. We are not obligated to treat unsolicited suggestions as confidential or to provide compensation for them unless we agree otherwise in writing.
SECTION 15 - INTELLECTUAL PROPERTY
The Service and its content, including the MUKIYA name, logos, product designs, graphics, photographs, videos, text, software, and page layouts, are owned by or licensed to MUKIYA and are protected by applicable intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for personal, non-commercial shopping and informational purposes. No other right or license is granted unless expressly stated in writing.
SECTION 16 - ERRORS, INACCURACIES, AND OMISSIONS
The Service may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, pricing, promotions, shipping charges, delivery estimates, or availability.
We may correct an error and update information. If a material error affects an order you have submitted, we may contact you for confirmation or cancel and refund the affected order, as permitted by law. We will not charge a higher corrected price without giving you the opportunity to agree where applicable.
SECTION 17 - PROHIBITED USES
You may not use the Service:
(a) for an unlawful, fraudulent, abusive, or deceptive purpose; (b) to violate applicable laws, regulations, sanctions, or the rights of another person; (c) to infringe intellectual property, privacy, publicity, or other proprietary rights; (d) to harass, threaten, defame, discriminate against, or harm another person; (e) to submit false or misleading information, reviews, claims, or account details; (f) to transmit malware, malicious code, or material that interferes with the Service; (g) to scrape, crawl, harvest, or collect data through automated means without permission, except as allowed by law; (h) to bypass security features, access controls, purchase limits, or technical restrictions; (i) to spam, phish, impersonate, or conduct unauthorized advertising; or (j) to use the Service or its content to build a competing commercial service without permission.
We may take proportionate action in response to prohibited conduct, including restricting access, cancelling affected transactions, preserving evidence, or reporting conduct where required or permitted by law.

Shopify and payment, analytics, advertising, customer support, shipping, and other service providers may process personal information as described in that policy and their own applicable notices.
SECTION 19 - DISCLAIMER OF WARRANTIES
We aim to provide accurate information, dependable products, secure checkout, and responsive customer support. Product purchases are covered by the express warranty, return rights, and statutory protections described in these Terms and the applicable policies.
Except for those express commitments and any rights that cannot lawfully be excluded, the Service is provided on an "as available" basis. We do not promise that the website will always be uninterrupted, error-free, or free from every harmful component, or that general informational content will be suitable for every purpose.
To the maximum extent permitted by law, implied warranties or conditions not expressly stated in these Terms are excluded. This exclusion does not apply where applicable law does not permit it.
SECTION 20 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer rights, or any other liability that cannot lawfully be excluded or limited.
To the maximum extent permitted by applicable law, MUKIYA and its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential losses, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the Service or a product, where such losses were not reasonably foreseeable or were not directly caused by our breach.
Where liability may lawfully be limited, our total liability for a claim relating to a purchased product will not exceed the amount you paid for the product giving rise to the claim. This limitation does not reduce any refund, repair, replacement, statutory guarantee, or other remedy that applicable consumer law requires us to provide.
SECTION 21 - INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless MUKIYA and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Service, your material breach of these Terms, or your infringement of a third party's rights.
This section does not require a consumer to indemnify MUKIYA for MUKIYA's own breach, negligence, unlawful conduct, or responsibility under applicable law.
SECTION 22 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified to the minimum extent necessary to make it enforceable. The remaining provisions will continue in effect.
SECTION 23 - TERMINATION
You may stop using the Service at any time. Obligations and liabilities incurred before termination will survive as necessary to give them effect.
We may suspend or terminate access to the Service for a material breach of these Terms, unlawful conduct, fraud, abuse, security risk, or other legitimate reason. Where appropriate, we may provide notice and an opportunity to remedy the issue.
Termination does not affect an accepted order, warranty claim, return right, payment obligation, intellectual property right, dispute provision, or other term that by its nature should survive termination.
SECTION 24 - ENTIRE AGREEMENT, ORDER OF PRECEDENCE, AND WAIVER
These Terms and the policies referenced in them form the agreement between you and MUKIYA regarding the Service. They replace prior agreements or communications on the same subject, but they do not replace product-specific terms or promises expressly provided with an accepted order.
If these Terms conflict with a product page, checkout disclosure, or a specific policy, the more specific term will govern the relevant subject. If a marketing statement conflicts with the detailed eligibility, procedure, or exclusions in an applicable policy, the policy controls, provided that this rule will not be used to withdraw a clear promise after an order has been accepted or to limit a non-waivable consumer right.
Our failure to enforce a provision is not a waiver of that provision or any other right.
SECTION 25 - GOVERNING LAW AND DISPUTES
